Terms & Conditions
1. Eligibility & Age Requirements
To place an order on our site, you must be at least 13 years of age. Customers between the ages of 13 and 17 must have parental or guardian consent and supervision when purchasing live animals. By placing an order as a minor, you represent that you have obtained that consent.
Adults purchasing on behalf of a minor remain responsible for the care of the animals and for compliance with these Terms.
If you are placing an order for a business or organization, you represent that you have the authority to bind that entity to these Terms.
2. Accounts & Account Security
Some features of our site may require you to create an account. When you create an account, you agree to provide accurate, current, and complete information and to keep that information updated.
You are responsible for safeguarding your account password and for all activity that occurs under your account. Notify us immediately at support@superiorshrimpaquatics.com if you suspect any unauthorized use.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect of fraudulent activity.
3. Orders, Pricing & Payment
Order Acceptance
Your order constitutes an offer to purchase, which we may accept or decline at our discretion. We reserve the right to refuse or cancel any order for any lawful reason, including but not limited to inventory shortages, pricing errors, suspected fraudulent activity, prior disputes, or shipping limitations to your location.
Pricing & Errors
All prices are listed in US Dollars (USD) and are subject to change without notice. While we make every effort to ensure pricing accuracy, errors can occur. If a pricing error is discovered after an order is placed, we reserve the right to cancel the order or contact you to confirm the corrected price before fulfilling.
Payment
Payment is processed through Shopify Payments and other authorized payment processors. By providing payment information, you authorize us to charge the applicable amount including products, shipping, and any taxes.
If a payment is declined, your order will not be processed. Repeated declined payments or chargeback abuse may result in account suspension.
Taxes
You are responsible for any sales tax, use tax, or other taxes applicable to your purchase. Tax is calculated at checkout based on your shipping address.
4. Live Animal Sale Disclaimer
Live animals are inherently perishable. Despite our best efforts in selection, care, and shipping, the sale of live animals carries risks that do not apply to other products. By purchasing live animals from SSA, you acknowledge and accept these risks.
Our liability for live animals is governed exclusively by our Live Arrival Guarantee. No additional warranty, express or implied, applies to live animals beyond what is set out in that policy.
Husbandry Responsibility
Once a live animal has been received and the Live Arrival Guarantee window has closed, the care, health, and survival of the animal becomes the sole responsibility of the buyer. We are not liable for losses, illness, breeding outcomes, or any other condition of an animal after the guarantee window.
Buyers are responsible for understanding the water parameters, tank size, diet, and compatibility requirements of any species they purchase. Care guides on our site are provided as a starting reference, not a guarantee of outcome.
Hitchhikers & Pest-Free
We quarantine and inspect all livestock, but pest-free arrival is not guaranteed. Microscopic eggs, snail eggs, and other small hitchhikers can occasionally arrive in any shipment. Buyers are responsible for quarantining incoming livestock and plants before adding them to an established tank.
5. Shipping & Delivery
All shipping is governed by our Shipping Info & Practices page, which is incorporated by reference. By placing an order, you agree to the shipping terms set out there, including but not limited to:
- Monday-only shipping schedule and Sunday 1:00 PM CT cutoff
- Delivery times are carrier estimates, not commitments
- Shipping charges are non-refundable
- Refused or undeliverable packages are a total loss
- Ground shipping is at the customer's risk
- The Live Arrival Guarantee applies to the first delivery attempt only
6. Returns, Refunds & Disputes
Live Animal Claims
All claims for dead or damaged live animals are processed under the Live Arrival Guarantee. No other return or refund policy applies to live animals.
Dry Goods & Non-Live Items
Returns for unused, unopened dry goods (food, equipment, accessories, hardscape, etc.) may be considered within 14 days of delivery. Return shipping is at the buyer's expense. Used or opened items are not eligible for return. Contact us before returning any item.
Chargebacks
If you have an issue with an order, please contact us first at support@superiorshrimpaquatics.com. We resolve nearly all issues directly. Filing a chargeback before allowing us to resolve the issue may result in the suspension of your account and a permanent block from future orders. We reserve the right to vigorously dispute chargebacks with full documentation.
7. Right to Refuse Service
Superior Shrimp & Aquatics reserves the right to refuse service, cancel orders, suspend accounts, or block customers at our sole discretion, including but not limited to the following reasons:
- Suspected fraudulent activity or payment abuse
- History of chargebacks or unresolved disputes
- Abusive, threatening, or harassing communication toward our staff
- Repeated violations of our shipping or guarantee policies
- Suspected commercial reselling without prior authorization
- Shipping addresses we are unable to serve safely
- Any other reason permitted by law
Refused or cancelled orders will be refunded in full unless the underlying issue (chargeback, fraud, etc.) prevents it.
8. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, product photography, care guides, illustrations, and the SSA brand, is the property of Superior Shrimp & Aquatics or used with permission, and is protected by US and international copyright and trademark law.
You may not copy, reproduce, modify, distribute, or use our content for commercial purposes without our prior written consent. Limited personal, non-commercial use is permitted (such as referencing a care guide for your own tank).
Our brand name, logo, and slogans are trademarks of Superior Shrimp & Aquatics and may not be used without permission.
9. User-Generated Content
If you submit reviews, photos, comments, or other content to our site or social channels, you grant SSA a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt that content for marketing, social media, and educational purposes.
You represent that any content you submit is your own original work, does not infringe on any third party's rights, and is not unlawful, abusive, or misleading.
We reserve the right to remove, edit, or refuse to display any user-submitted content at our discretion.
10. Prohibited Uses
You agree not to use our site or services for any unlawful purpose or in any way that could damage, disable, or impair the site. Prohibited activities include:
- Attempting to gain unauthorized access to our systems or other users' accounts
- Using bots, scrapers, or automated tools to access the site without permission
- Interfering with the site's normal operation or other users' experience
- Submitting false, misleading, or fraudulent information
- Using our site or content to promote illegal activity or wildlife trafficking
- Reselling or redistributing our products commercially without prior wholesale authorization
- Harassment, threats, or abusive communication toward our staff or other customers
11. Disclaimer of Warranties

We do not warrant that the site will be uninterrupted, secure, or error-free, or that any information provided (including care guides, parameter ranges, or compatibility notes) is complete or accurate for your specific setup.
Live animal warranties are limited exclusively to the terms of our Live Arrival Guarantee.
12. Limitation of Liability
To the maximum extent permitted by law, Superior Shrimp & Aquatics, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, lost livestock beyond the order in question, tank damage, or emotional distress, arising from your use of our site or products.
Our total liability for any claim arising from or related to your purchase or use of our site is limited to the amount you paid for the specific order giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Superior Shrimp & Aquatics, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your violation of these Terms, your misuse of our site or products, or your violation of any third party's rights.

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles.
Any dispute arising from or relating to these Terms or your use of our site shall be resolved in the state or federal courts located in St. Louis County, Minnesota, and you consent to the personal jurisdiction of those courts.
Before initiating any formal legal action, you agree to first contact us in writing at support@superiorshrimpaquatics.com and allow us a reasonable opportunity (at least 30 days) to resolve the dispute informally.

We may update these Terms at any time. The "Effective Date" at the top of this page reflects the most recent revision. Material changes will be noted by updating the Effective Date.
